Sydsudans föredömliga konstitution

Sydsudan står nu inför ett nationsbygge av enorma proportioner. En grundsten är emellertid redan lagd - nationens konstitution. Detta är förvisso en övergångskonstitution - men det går att anta att grunderna i denna kommer att bevaras också i fortsättningen. Igår svor president Salva Kiir följande ed utifrån denna konstitution:

“ I......................., do hereby swear by the Almighty God/ solemnly affirm, that as the President of the Republic of South Sudan, I shall be faithful and bear true allegiance to the Republic of South Sudan and shall diligently and honestly discharge my duties and responsibilities in a consultative manner to foster the development and welfare of the people of South Sudan; that I shall obey, preserve and defend the Constitution and abide by the law; and that I shall protect and promote the unity of the people of South Sudan and consolidate the democratic decentralized system of government and preserve the integrity and dignity of the people of South Sudan; so help me God.”


En ed som onekligen påminner om den amerikanska president-eden, som alltså lyder så här:

I, AB, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.


Med det sagt låter väldigt många demokratiska trohetseder ungefär på samma sätt. Men det finns fler likheter med USA. Sydsudan har också i sin konstitution en "bill of rights", som för att ge ett exempel konstaterar följande om kvinnor i det sydsudanesiska samhället:

(1) Women shall be accorded full and equal dignity of the person with men.

(2) Women shall have the right to equal pay for equal work and other related benefits with men.

(3) Women shall have the right to participate equally with men in public life.

(4) All levels of government shall:

(a) promote women participation in public life and their representation in the legislative and executive organs by at least twenty-five per cent as an affirmative action to redress imbalances created by history, customs, and traditions;
(b) enact laws to combat harmful customs and traditions which undermine the dignity and status of women; and
(c) provide maternity and child care and medical care for pregnant and lactating women.
(5) Women shall have the right to own property and share in the estates of their deceased husbands together with any surviving legal heir of the deceased.


Eller ta detta om religionsfrihet:

The following religious rights are guaranteed by this Constitution:

(a) the right to worship or assemble in connection with any religion or belief and to establish and maintain places for these purposes;
(b) the right to establish and maintain appropriate faith-based, charitable or humanitarian institutions;
(c) the right to acquire, possess and own movable and/or immovable property and make, acquire and use the necessary articles and materials related to the rites or customs of religion or belief;
(d) the right to write, issue and disseminate religious publications;
(e) the right to teach religion or beliefs in places suitable for these purposes; (f) the right to solicit and receive voluntary financial and other contributions
from individuals, private and public institutions;
(g) the right to train, appoint, elect or designate by succession appropriate
religious leaders called for by the requirements and standards of any
religion or belief;
(h) the right to observe days of rest, celebrate holidays and ceremonies in
accordance with the precepts of religious beliefs; and
(i) the right to communicate with individuals and communities in matters of
religion and beliefs at national and international levels.


Man behöver inte vara expert på internationell juridik för att förstå att grunden i det sydsudanesiska nationsbygget - oavsett vilka hinder som nationen onekligen kommer att möta på den långa väg de nu börjat vandra - är en bra sådan. Sydsudan kommer i stor utsträckning (och jämförelsevis) att bli ett land präglat av kristendom. Vilket kan sättas i jämförelse med norra Sudan under president Bashir. Konstitutionen ovan reflekterade vad som förhoppningsvis kommer att representera Sydsudans framtid - klippet nedan visar vad som tragiskt nog representerar en annan del av Sudan (eller en tid när hela Sudan styrdes av en annan regim), där man utifrån en annan tro (och en annan teologisk sådan) har en annan syn på dessa saker:



Här är ett annat klipp om piskandet av kvinnan - som alltså straffades i enlighet med sharia-lagar för att hon burit byxor under sina muslimska kläder. Det är ett mycket obehagligt klipp där poliserna alltså skrattar åt den livrädda och torterade kvinnan:



Det vore trevligt om vänsteraktivister "för mänskliga rättigheter" spenderade mer tid på att förhindra saker som detta, än på att bojkotta Israel och att skriva böcker som utmålar folk som Mike Huckabee som kristna talibaner.

Kvinnorna i Sudan bör dock inte hoppas alltför mycket på den västerländska vänstern. Däremot kan man nu hoppas på att Sydsudan ska bli ett ljus i en annars mörk omgivning. Ett ljus USA under såväl George W. Bush som Barack Obama, onekligen verkat för att tända och som världen nu måste hjälpa till med att bevara lysande.
